Several proceedings, one dispute
A single separation can generate a divorce petition, a maintenance application under section 125 CrPC or personal law, a custody or guardianship petition, a domestic violence proceeding, and a civil suit over property: often in different forums, sometimes in different cities. They are legally distinct and factually identical, and what is said in one is used in all of them.
Children are not a bargaining position
Custody is decided on the welfare of the child, and courts are alert to custody being used as leverage on money. An arrangement proposed because it genuinely works for the child carries weight; one proposed to improve a negotiating position tends to be seen for what it is, and it damages the party who advanced it.
The family home
The right to reside in a shared household under the Domestic Violence Act is independent of who owns it, and an order can secure residence or alternative accommodation regardless of title. Ownership questions are separate and are decided on the documents, which is why the property record matters even in a matter that feels entirely personal.

Common questions
Questions we are asked most often
Not necessarily. A transfer petition can move a proceeding, and courts have consistently recognised the hardship of a party: often the wife with a young child, travelling to defend.
